Terms of Service — prospective software scope

Published 2026-10-03. Effective for new registrations from publication of this version; no retroactive change to previously accepted terms or purchases.

Separato is independent self-service software for people navigating separation themselves. These service and purchase provisions apply prospectively to new users and any future purchases. They do not replace terms you previously accepted or commitments made for existing purchases.

What Separato is

Separato provides free basic tools for support estimates and co-parenting organization. Additional paid self-service features are planned. New paid purchases are unavailable while their scope, delivery and prices are defined. No new separation-agreement purchase is offered.

Software and separate legal services

• Separato is not a law firm and does not provide legal advice. Optional legal services are agreed directly with an independently engaged lawyer of your choice, separately from platform software. A provider listing is not an endorsement or a lawyer-client relationship. Confirm credentials, availability, scope and fees directly; you may choose a provider outside the directory.
• Separato is not a crisis service. If you are in immediate danger, call 911.
• Calculators provide estimates only based on the Federal Child Support Guidelines, Spousal Support Advisory Guidelines, and provincial property statutes. A court can order an amount that differs from any estimate.

New purchases and pricing

Basic tools remain free. No new paid packages or prices are offered by this version. Before any future paid software purchase, its scope and platform price will be presented for your decision. Legal advice, review and representation are separate services and fees; none is bundled with a new platform purchase.

Existing purchases and accepted terms

Existing purchases, stored sessions and agreements, payment history, entitlements and legal rights are preserved. This prospective notice does not withdraw prior ILA or delivery commitments, shorten an agreed notice period or reduce refund rights. Existing users retain their previously accepted terms, including applicable 30-day pricing notice and pro-rata unused-service refund commitments. Continued use does not retroactively accept this change. Contact support about an existing purchase; no automated migration, cancellation or refund is performed by this notice.

Safety screening

Every Separato session begins with an intimate-partner-violence screener (MASIC). If the screener identifies serious safety concerns, we will not proceed with AI-facilitated mediation — instead, we will provide referrals to Canadian crisis services and legal aid. Mediation requires safety on both sides; we will not facilitate a process where one party may not freely consent.

Your obligations

• Provide accurate financial and family information. Material misrepresentation may invalidate the resulting agreement and may be a criminal offence under Canadian law.
• Do not impersonate, harass, or threaten the other party through the platform.
• Do not attempt to circumvent security, scrape the service, or reverse-engineer our software.

Termination

You may close your account at any time. We may suspend or terminate accounts that violate these terms or pose a risk to other users. Where you have purchased an agreement that is not yet complete, we will refund the unused portion on a pro-rata basis.

Limitation of liability

To the maximum extent permitted by Canadian law, Separato's aggregate liability for any claim arising from the service is limited to the amount you paid us in the twelve months preceding the claim, or CAD $100, whichever is greater. We do not exclude liability that cannot lawfully be excluded.

Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario. The courts of Ontario have exclusive jurisdiction.
